It's funny to hear that the more popular game was actually the knockoff, and it is kind of dickish of them to try and cancel his trademark (Which really shouldn't fuck him over as hard as he is playing it), but I don't feel sorry for the dev here. The clone excuse doesn't really work when both games are just flavored versions of the match-three game-type which has existed for a very long time. They may have stolen the candy shtick (Which is stupid, cause it really isn't all that great of a theme anyways), but that was not a major factor in the rise of CandyCrush's popularity. If Ransom had developed it for facebook and not android, he might had a shot at grabbing the spot that King got, but he didn't and that is too bad. By this point I'd assume most of CandySwipe's fanbase came from riding on the tail of CandyCrush's rise, so even though his game existed first, it is just another feeder.

DId CandySwipe have a two years jump on CandyCrush? If so, then Crush succeeded where Swipe failed. Popularity. It seems to me that Crush just did better at catching people to play the game. Swipe couldn't get Crush's popularity even with a two year head start. It sucks but that's what happened.

So no, I don't feel bad for Swipe or the developer and his sob story.

They tried to trademark the term 'candy' for a whole huge swath of things, including shit like baby monitors and other things that have nothing to do with their video game, a while ago. Last I heard they were also being assholes and trying to trademark the term 'saga' and go after The Banner Saga because supposedly it could cause confusion. I guess they figure their user base is so stupid that they don't know what the word saga means and would mix up a Bejeweled clone and a turn-based tactical RPG.
