In some ways a DvL can be rogue. By the definition of the term, my DvL went 'rogue'. He performed an action that the Union wouldn't approve of, but he could justify it in it being advantageous to the unions goals... or rather what he saw the unions goals to be. If someone means 'full rogue' , as in attacking union personel and actively betraying the Union then they can't, but they can perform things as long as it's visibly justifiable. For instance, my DvL halted a citizens torture. His justification was that gaining the hearts and minds of the people was paramount to achieving the unions goals. It worked, the citizen he saved later reported rebel activity. I did stuff like that semi-often, paying people more than they would usually receive for tasks in favour of the union, and was generally considered the 'soft' DvL. But I was the most successful, had the largest and one of the best divisions etc. Turns out getting the citizens to like me really was a good idea xD
But if a judgement waiver was called, all the citizens would shit themselves, because I used to come along, charge the block with permissive inactive cohesion for 'giving consent through inaction' for whatever crime warrernted the judgement waiver, take a group of them off (tagged 'political conscripts' cause lol) then have them executed for group punishment. Oh, and if one of my units was ever shot, have fun without rations for the next few days xD
